NY appeals court orders NJ programmer's acquittal

(AP) ? A federal appeals court on Friday reversed the conviction of a former Goldman Sachs programmer on charges he stole computer code, ordering an acquittal in a case that tested the boundaries of what can be considered a crime as companies seek to protect their intellectual property from competitors.

The unusually speedy mandate from the 2nd U.S. Circuit Court of Appeals in Manhattan will result in freedom for Sergey Aleynikov, of North Caldwell, N.J. He has been in prison since he was sentenced in March to more than eight years in prison. He was convicted in December 2010 of stealing trade secrets and transporting stolen property in interstate and foreign commerce.

A three-judge appeals panel heard arguments on Thursday, but the judges gave no indication that they would reverse the lower court hours later with a terse, one-paragraph order. The 2nd Circuit said it would issue a written ruling "in due course" to explain its decision.

Aleynikov's attorney, Kevin Marino, said he spoke with his client Friday. He said Aleynikov reacted by concluding: "There is justice in the world."

"I could not be happier," Marino said. "It's justice because Sergey Aleynikov did not commit either of the crimes with which he was charged. The government's attempt to stretch this criminal federal statute beyond all recognition resulted in a grave injustice that put Sergey Aleynikov in prison for a year."

In arguments before the 2nd Circuit on Thursday, Marino called it "ridiculous" and "preposterous" that his client was facing eight years in prison because he was found to have information that was not a product that Goldman Sachs sold in interstate and foreign commerce. A prosecutor had asked the court to uphold the conviction, saying protection of trade secrets was the only way companies could retain their technological advantages.

Prosecutors declined to comment Friday.

Aleynikov, a naturalized U.S. citizen who emigrated from Russia in 1990, was first arrested in July 2009 as he returned from a trip to Chicago to the offices of his new employer, Teza Technologies LLC.

Prosecutors accused him of taking trade secrets from Goldman Sachs Group Inc. in 2008 to help his new company gain an advantage with high-speed trading. He made $400,000 as a vice president at Goldman Sachs. His move to Teza enabled him to be paid $300,000 annually, with a $700,000 bonus in his first year and a revenue-sharing plan that would have added $150,000 annually.

During a two-week trial, Marino told jurors that his client was merely trying to copy parts of the company's software that were taken from public software codes. He acknowledged that Aleynikov had violated the company's confidentiality agreements but said that was a civil matter.

The trial brought into focus sophisticated computer programs that use mathematical formulas to execute scores of trades in short periods of time after evaluating moment-to-moment developments in the markets.

The government said Goldman Sachs makes millions of dollars a year in profits from high-frequency trading and carries a competitive advantage over rivals because of the speed of its computer programs.

At sentencing, Aleynikov said he very much regretted "the foolish decision to download information before I left Goldman Sachs," though he added that only some of the information he took was proprietary to the company.

He said he "never meant to cause Goldman any harm, and I haven't acted with malice to anyone at the bank."

Ghana needs to build up a strong skillful personnel base to cash in on economic fortunes Business Processing Outsourcing (BPO) industry presented and to compete well with sector giants like India and Sri Lanka.

Dr Osei K. Darkwa, President of the Ghana Telecom University (GTUC) who made the recommendation added that the development of critical mass of BPO skilled personnel to manage areas including customer service support, telemarketing and data entry was critical if the country would survive in the industry.

He was speaking on Tuesday at a ceremony organized to open up eight-week Information Technology Enabled Services and Business Processing Outsourcing (ITES/BPO) Work Readiness Programme in Accra.

The objective of the programme which is underway is to provide ITES/BPO skills to 150 poor and vulnerable youth to enable them gain employment in the growing industry.

The training, which is sponsored by Rockefeller Foundation and technically supported by GTUC, is expected to focus on providing the participating youth with skills in data entry and document as well as entrepreneurial and soft skills to help the beneficiaries gain employment in BPO companies to digitize some selected government departments and agencies? manual records.

The programme under the auspices of the ITES Secretariat of the Ministry of Communication (MoC).

Dr Darkwa said GTUC was proud to provide tools and hands-on-training for the participants adding ?we have the expertise, the infrastructure and personnel to undertake the training.?

He expressed confidence that the training would equip the participants to unleash the energy and creativity embedded within them adding, ?In this knowledge-based economy, this training will make you a major player of the global economy system.?

Dr Robert A. Baffour, Vice President of GTUC, expressed dissatisfaction in bad working attitude of most employees who worked lackadaisically solely because they thought the business did not belong to them so they could afford to care less.

In contrast to that bad perception, he cautioned them to excel to improve themselves and the country.

?Wherever you find yourself, you need to put in all the energy as if the business or the office you work is yours. Own the work place.?

Patrick M. Osman, a Ghanaian but a Libyan returnee told the Ghana News Agency that he was hopeful the training opportunity would enable him adopt a professional and ethical attitude towards his work to improve productivity.

He said he had not had the opportunity to attain tertiary education in any discipline and therefore relished the chance offered him at GTUC.

Mr Osman said though he had spent fruitless years labouring in Libya, the ITES, BPO training programme would help him gain and reverse the fruitless years lost.

Mr Paul Panzy Wormade, an unemployed graduate of Ho Polytechnic was grateful to GTUC, ITES Secretariat of the MoC for the privilege.

He said he was determined to put in his best and was optimistic he would secure a job after the training.

DUBAI, United Arab Emirates (AP) -The chairman of Al Wasl says his aim is to keep coach Diego Maradona happy.

Maradona said last week that he would consider leaving the UAE club if the player budget wasn't increased significantly next season, complaining he wasn't able to compete with other teams.

On Wednesday, Marwan bin Beyat said he had not heard directly from Maradona about his concerns but said his aim was to "always make him happy." He said he has told Maradona to put "his requirements for next season in writing" and they would be discussed.

Maradona signed a two-year deal with the club in May.

Many of us tend to be terrified about presenting and public speaking. It can be a scenario which puts a lot of anxiety as well as pressure on most people. There are several means of combating this presenting and public speaking pressure that will give you some help in your speech or presentation.

MTV News spent hours interviewing artists and stars on the Grammy red carpet. After everyone was inside Los Angeles' Staples Center, some of the news team made their way backstage while the rest made their way to their seats. Here are some observations that anyone watching from their couch would never have seen:

Pretty Please, More Pink: Inside Staples Center, they play highlights from past shows during commercial breaks. Pink's performance of "Glitter in the Air" captivated the audience so much that when they cut back to the show, the entire crowd groaned.

Mother Monster's Security Detail: Lady Gaga moved through the arena flanked by two bodyguards in order to make it safely to her seat in time for Recording Industry President Neil Portnoy's speech. Gaga was also safer than the Beatle in the house. Sir Paul McCartney had no protection during his dual-performance night.

Get Up, Stand Up: The audience inside Staples Center seemed unsure of when to stand up and sit down all night. The minute Paul McCartney appeared onstage, all that uncertainty disappeared.

One Step Behind?: While Chris Brown's footwork looked quite impressive on air, our source told us the vibe inside Staples was lukewarm after his physical performance.

Join the Band: Many audience members were given arm bands with a Coldplay logo on it and told to put them on during the band's performance with Rihanna.

The Standing O You Missed: When Tony Bennett won a Grammy for Best Pop Performance by a Duo or Group for his duet with Amy Winehouse during the pre-televised ceremony, the crowd rose to its feet. "We shouldn't be here. Our darling daughter should be here," Winehouse's father Mitch said after embracing Bennett.

On the Bubble: The night's big winner, Adele, was chewing gum backstage after her triumphant performance of "Rolling in the Deep." That applause you heard on TV was no joke. The crowd inside Staples was blown away.

A fighter pilot heads back to base after a long mission, feeling spent. A warning light flashes on the control panel. Has she noticed? If so, is she focused enough to fix the problem?

Thanks to current advances in electroencephalographic (EEG) brain-wave detection technology, military commanders may not have to guess the answers to these questions much longer. They could soon be monitoring her mental state via helmet sensors, looking for signs she is concentrating on her flying and reacting to the warning light.

This is possible because of two key advances that made EEG technology wireless and mobile, says

Scott Makeig, director of the University of California, San Diegos Swartz Center for Computational Neuroscience (SCCN) in La Jolla, Calif. EEG used to require users to sit motionless, weighted down by heavy wires. Movement interfered with the signals, so that even an eyebrow twitch could garble the brain impulses.

Modern technology lightened the load and wirelessly linked the sensors and the computers that collect the data. In addition, Makeig and othersdeveloped better algorithms?in particular, independent component analysis. By reading signals from sevedata recovery san joseral electrodes, they can infer where, within the skull, a particular impulse originated. This is akin to listening to a single speakers voice in a crowded room. In so doing, they are also able to filter out movements?not just eyebrow twitches, but also the muscle flexing needed to walk, talk, or fly a plane.

EEGs most public ce may be two Star Wars-inspired toys,Mattels MindflexandUncle Miltons Force Trainer. Introduced in 2009, they let wannabe Jedi knights practice telekinesis while wearing an EEG headset. But these toys are just the tip of the iceberg, says Makeig, whose work includes mental concentration monitoring. Did you push the red button and then say, Oops! to yourself? It would be useful in many situations?including military?for the system to be aware of that.

That kind of mental gas gauge is just one of many projects Makeig is running at the SCCN, which is part of UC San Diegos Institute for Neural Computation (INC). He also combines mobile EEG with motion-capture technology, suiting volunteers in EEG caps andLED-speckled spandex suitsso he can follow their movements with cameras in a converted basement classroom. For the first time, researchers like Makeig can examine the thoughts that lead to movement, in both healthy people and participants with conditions such as autism. Makeig calls the system Mobile Brain/Body Imaging, or MoBI. It allows him to study actions at the speed of thought itself, he says.

EEG does not directly read thoughts. Instead, it picks up on the electrical fields generated by nerves, which communicate via electricity. The EEG sensors?from the one on theStar Warsgames to the 256 in Makeigs MoBI?are like microphones listening to those microvolt-strength neural signals, says Tansy Brook, head of communications forNeuroSkyBrain-Computer Intece Technology in San Jose, Calif., makers of the chip in the Star Wars toys and many other research, educational and entertainment products.

For one project, Makeig is collaborating with neuroscientists Marissa Westerfield and Jean Thompson, UC San Diego researchers studying movement behavior in teenagers with autism. They put the teens, wearing the EEG sensors and LEDs, in Makeigs special classroom. Then, they project a spaceship on the walls. The kids have to chase the spaceship as it darts from one point to another. Although the results are not yet in, Westerfield suspects that people with autism, compared with those who are non-autistic, will take longer to process where the spaceship has gone and readjust their movements toward it. If we had a better idea of the underlying deficits?then we could possibly design better interventions, such as targeted physical therapy for the movement problems autistic people have, Westerfield says.

Neuroscientists and psychologists have been using EEG to eavesdrop on brain waves since 1926, and doctors employ it to study sleep patterns and observe epileptic seizures. During most of that time, subjects had to sit in an electrically shielded booth, like a big refrigerator, saysJohn Foxe, a neuroscientist at Albert Einstein College of Medicine in New York City. He calls Makeigs MoBI technical wizardry that will enable scientists to watch the brain and how it works in much more realistic settings.

Wireless EEG has already had an impact on gaming. San Francisco-based Emotiv has since 2009 sold itsEPOC EEG headset, which uses electrical signals to determine a players emotional state?excitement, frustration, and boredom each create a different pattern. Gamers using Emotivs technology can also create mental spells to lift or push virtual objects, says Geoff Mackellar, CEO of Emotivs research unit based in Sydney, Australia. The EPOC is also regularly used in research labs and may have medical applications in the future, Mackellar adds.

Wireless EEG technology provides signals as clear as the wired version, Makeig says, and at about 3.5 kilograms his machinery is luggable. (Emotivs and NeuroSkys headsets, which use fewer electrodes, are lighter.) Of course, were not starting with ballet dancers doing The Rite of Spring, he admits, but the team has succeeded with joggers on a treadmill. One challenge they would still like to overcome is to remove the sticky, conductive gel that goes under each electrode. It can certainly be done?Emotivs electrodes use only saltwater and NeuroSkys are dry.

Tzyy-Ping Jung, associate director of the SCCN, predicts the group will make a dry, 64-electrode system within a couple of years. He and Makeig envision the headset willhelp paralyzed people interact with the world, warn migraine sufferers of an impending headache, and adjust computerized learning to match a students personal pace, among other potential applications.
